Medical Marijuana in Maine
On November 2, 1999, sixty-one percent of Maine voters approved Question 2 and the law became effective on December 22, 1999. Question 2 removed Maine state-level criminal penalties for the possession, use and cultivation of marijuana by Patients who have an oral or written “professional opinion” from their doctors stating that he or she “might benefit from the medical use of marijuana.” A qualifying patient, including a non registered and a voluntarily registered qualifying patient, may designate a primary caregiver to assist the qualifying patient with the patient’s medical use of marijuana. A primary caregiver may cultivate up to a total of 6 mature marijuana plants for each qualifying patient served when the qualifying patient has designated the primary caregiver for that purpose on a department-approved designation form.
